JIU JITSU ACCIDENT WAIVER & RELEASE OF LIABILITY
Please read carefully before signing.
This release is executed on {sign_date} by {name}, ("Releasor"), to Baltimore Brazilian Jiu Jitsu, Baltimore Brazilian Jiu Jitsu, and Robert Sullivan 412 Eastern Blvd, Essex, MD 21221 ("Releasee").
Releasor, being of lawful age (18+), understands and acknowledges that Jiu Jitsu is a sport in which there is inherent risk of bodily harm. Releasor further understands that participation in Jiu Jitsu involves exercises involving physical contact, which while not intended to impose serious bodily injury under the conditions practiced at Baltimore Brazilian Jiu Jitsu, may invariably result in such injury through the actions of the parties involved. Jiu Jitsu involves throws, take-downs, arm locks, joint locks, leg locks, foot locks, chokes and other potentially deadly and debilitating techniques. While the objective of instruction is to foster self defense skills, the practicing of such techniques exposes the participant to the risk of injury. This includes all aspects of the sport of Folkstyle, freestyle and Greco-Roman wrestling.
Portions of the class involve the instructor teaching various techniques to students and demonstrating how these techniques are properly applied in a self-defense context. In order for the students to learn how to correctly apply these techniques in a self-defense context, the students must "spar" with each other and/or the instructor. The instructor emphasizes that once a technique is applied in a manner that is potentially sufficient to achieve the desired self-defense outcome, the student to whom the technique is being applied should immediately signal the other by tapping the other student's body and/or verbally signaling the other student to immediately cease contact. All students are instructed to immediately ceased physically contact and to cease application of any and all techniques that are applied at the very moment that they are physically or verbally signaled to do so by the other student who is being sparred against and/or the instructor.
While Baltimore Brazilian Jiu Jitsu, takes extensive measures to help prevent injury by using the proper teaching of techniques and by strictly enforcing its policies on how students should signal each other to cease contact, Releasor fully understands that when practicing such techniques, such activity is an inherently dangerous activity. Releasor also understands that Baltimore Brazilian Jiu Jitsu, is in no way responsible for the actions taken by other students. Releasee is there fore not responsible for the intentional, reckless or negligent actions taken by other students against the Releasor. Releasor understands that Jiu Jitsu involves close physical contact, including skin to skin contact which may result in the transmission of skin diseases as well as a variety of other infections, viruses, and/or ailments (including by not limited, to abrasions of the skin, cuts, sprains, etc.)
Therefore, Releasor, in consideration of being permitted to participate in the practice of Jiu Jitsu at Baltimore Brazilian Jiu Jitsu, does for himself/herself, his/her heirs, executors, administrators and assigns, release and forever discharge Releasee, its employees, instructors, agents, heirs, executors, sponsors, advertisers, owners, future claim, demand, action or right of action, of whatever kind or nature, either in law or property damage resulting from any incident, accident or occurrence that may occur as a result of Releasor's participation in Jiu Jitsu, or any activities in connection therewith on Releasee's premises. Releasor also agrees that Releasee is released from any claim whatsoever on account of first air, treatment, or service rendered to Releasor during or after participation in Jiu Jitsu at Baltimore Brazilian Jiu Jitsu.
This Release contains the entire agreement of the parties with respect to the subject matter hereof, and all prior contemporaneous agreements, written or oral, are merged herein and are of no further force or effect. This Release may be modified or amended only by a written agreement signed by Releasor and Releasee.
In the event that any provision hereof becomes or is declared by a court of competent jurisdiction to be illegal, unenforceable or void, this Release will continue in full force and effect without said provision.
All questions regarding the validity and interpretation of this Release shall be governed by, construed, and enforced in all respects, in accordance with the laws of the State of Maryland. Venue for any actions arising out of any of the terms contained herein shall be the State Courts located in Baltimore County, Maryland, regardless of where the activities contemplated under this Release are to be performed in whole of in part.
Releasor agrees that the parties to this Release shall submit any and all disputes relating to this Release or otherwise contract, tort, or both, to binding arbitration in the State of Maryland in accordance with the Maryland Uniform Arbitration Act, §§ 3-201 - 3-234 of the Maryland Code. Arbitration will be administered by the American Arbitration Association under its Commercial Arbitration Rules before a mutually agreed upon arbitrator. The arbitrator will be final, conclusive and binding on the parties to the arbitration. Judgement may be entered on the arbitrator's decision in any court having jurisdiction. The arbitration proceedings will be governed by the laws of the State of Maryland. Releasor hereby consents to the personal jurisdiction of the state courts of arbitration to which Releasor and Releasee are parties.
